The right to appoint a person of trust
The person of trust represents the patient and acts as the patient’s ‘spokesperson’ when the latter is no longer able to make decisions regarding their health on their own.
The patient’s person of trust must not be confused with their accompanying person.
The person of trust exercises the patient’s rights in relation to their health if the patient is no longer able to make decisions regarding their own health.
Role
The role of the person of trust is to speak for and act for the patient, if the latter is no longer capable of making decisions regarding their health.
Professional secrecy
An exemption to the obligation of professional secrecy is made for the person of trust.
Appointment
To appoint a person of trust, a dated and signed document must be filed: Guichet.lu.
Patient file
The person of trust may access the patient’s medical file, by exercising the rights of the patient who is not able to act on their own behalf.
